Terms of Service — ApliFlow

§1 General provisions

1. These Terms of Service ("Terms") set out the rules for using the ApliFlow website available at https://apliflow.pl ("Service") and the terms of providing electronic services by the Provider.

2. The Provider is Encode Marek Czarnowski, registered at Mała Huta 42E, 16-402 Suwałki, Poland, Tax ID (NIP): 8442256350, Registration No. (REGON): 362210145 ("Provider").

3. The Provider can be contacted at: kontakt@apliflow.pl.

4. Using the Service constitutes acceptance of these Terms.

§2 Definitions

• User — a natural or legal person, or an organisational unit, using the Service.
• Client — a User who has entered into a services agreement with the Provider under a chosen Plan.
• Plan — a service package (Basic, Starter, Professional, Enterprise) described in the Service pricing, differing in scope and limits.
• Account — an individual Client profile within the system enabling use of the Service's features.

§3 Terms of use

1. Using the Service requires a device with internet access and an up-to-date web browser.

2. A demo/presentation of the Service is requested via the contact form available on the Service.

3. A services agreement is concluded once the details of cooperation are agreed and the selected Plan is accepted by both parties.

4. Users must provide accurate information and must not take actions that could disrupt the operation of the Service.

§4 Plans, payments and contract duration

1. The current Plan pricing is available in the "Pricing" section of the Service and may change, provided that a price change does not affect agreements already in force.

2. Fees for the chosen Plan are charged on a recurring (monthly) basis, according to the billing period indicated for the given Plan, unless otherwise agreed by the parties.

3. For the Enterprise Plan, pricing and scope of services are agreed individually based on a separate quotation.

4. Failure to pay on time may result in suspension of Account access until the outstanding amount is settled.

5. Clients may terminate the service subject to the notice period set out in the individual agreement.

§5 User rights and obligations

1. Users agree to use the Service in accordance with its intended purpose, applicable law and good practice.

2. It is prohibited to use the Service for unlawful purposes, including processing personal data without a proper legal basis.

3. Users are responsible for the content and data entered into the Service as part of their application rounds and forms.

§6 Provider rights and obligations

1. The Provider makes reasonable efforts to keep the Service running continuously and without interruption, reserving the right to technical downtime necessary for maintenance or updates.

2. The Provider undertakes to protect data processed in the Service in accordance with applicable data protection law (GDPR).

3. The Provider reserves the right to temporarily suspend an Account in case of a breach of these Terms by the User.

§7 Liability

1. The Provider is not liable for damages resulting from improper use of the Service by the User, including data loss caused by the User's actions.

2. The Provider is not liable for interruptions in access to the Service resulting from causes beyond its control, including internet connectivity failures or force majeure.

§8 Complaints

1. Complaints regarding the functioning of the Service should be reported to: kontakt@apliflow.pl.

2. A complaint should include a description of the reported issue and contact details enabling a response.

3. The Provider handles complaints within 14 business days of receipt.

§9 Personal data protection

1. The Provider is the controller of personal data processed in connection with the use of the Service.

2. Detailed rules for processing personal data are set out in the Service's Privacy Policy.

§10 Final provisions

1. The Provider reserves the right to amend these Terms. Users will be notified of any changes with reasonable notice by publishing the updated Terms on the Service.

2. Matters not regulated by these Terms are governed by applicable Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.

3. Any disputes arising from the use of the Service shall first be resolved amicably; failing agreement, the competent court shall be determined in accordance with applicable law.
